Professor James Sample was quoted in The National Law Journal article “First Circuit Questions Intent of Judge Accused of Blocking ICE Arrest” on December 6, 2021.

Still, some judicial ethics experts say dismissing the charges based on judicial immunity would be premature. James Sample, a law professor at Maurice A. Deane School of Law at Hofstra University, said more fact finding is likely needed to determine whether Joseph and MacGregor acted within the scope of their judicial function.

“The issue to be determined is whether the acts of Judge Joseph and Mr. MacGregor in shepherding the suspect out of the courthouse fell within, or outside, the scope of their judicial function,” Sample said. “The determination of where, vis-à-vis that line of demarcation Judge Joseph’s and Mr. MacGregor’s actions, will be a fact-intensive inquiry.”
