On March 3, the Second Circuit will hear arguments on the Southern District’s decision — based on the Federal Arbitration Act and labor law notions of fairness — to vacate the NFL’s discipline of football star Tom Brady for his supposed role in the football tampering scandal popularly known as Deflategate.
The article examines different legal roads that could have been taken, while sportingly reminding NFL players that the present NFL protocol may best afford opportunities for court intervention.
