LI casino’s future awaits ruling on obscure legal question

The issue in this case is whether hotels customarily house casinos, or whether such arrangements are rare.

“If you look at it broadly, it can be considered customary,” Hofstra Law School professor Ashira P. Ostrow said in an interview. “In general, there are many hotels that have casinos. . . . There would be enough evidence for the board to conclude, I think, that it is part of accessory use.”
