Deane School of Law at Hofstra University, told Law360 that front-running is cut from the same cloth as insider trading, and it’s unsurprising that advancing an insider trading theory to the jury would resonate, since the public is generally familiar with such charges.
“Even though some folks aren’t exactly experts on securities regulations, insider trading is something that the popular imagination has some familiarity with, and I think that helps the prosecution,” Colombo said.
