An article by Professor Scott J. Glick ’81, “Consequence, Weapons of Mass Destruction, and the Fourth Amendment’s ‘No-Win’ Scenario,” made the SSRN Top Ten download lists for National Security and Foreign Relations and for Legislation.

The article had previously made the SSRN Top Ten download lists for Criminal Procedure and for the Role of Legislators.

The article, which will be published as the lead article in Volume 90 of the Indiana Law Journal, explores the issue of whether consequence — that is, the nature and gravity of the harm the government seeks to prevent — should ever play an outcome-determinative role in a Fourth Amendment analysis.
