Prof. Ronald Colombo Signs 2 Amicus Briefs in Support of Little Sisters of the Poor

Professor Ronald J. Colombo joined other constitutional law scholars on two amicus briefs in support of the Little Sisters of the Poor (before both the Third and Ninth Circuits). The briefs support the right of the Little Sisters, a religious order of nuns, to an exemption from the contraceptive mandate of the Affordable Care Act.

An exemption to the mandate was granted by the U.S. Department of Health and Human Services, but California, Pennsylvania, and New Jersey are challenging the exemption as unconstitutional.

The SEC could ask the judge to ban Musk from Twitter for a period of time. That could raise novel First Amendment issues, said [Ronald] Colombo, securities professor at Hofstra University’s Maurice A. Deane School of Law. Free speech arguments have gained little traction against contempt remedies to date, he said, because the orders are not ordinarily challenged. But Musk’s is no ordinary case.

“You ordinarily accept what they give you because you don’t want something worse, unless it’s the worst thing in the world,” Colombo said. “To cool his jets on Twitter shouldn’t be the end of the world for him, but maybe it is.”

Hofstra Law Offers Free Legal Clinic for Veterans on March 31, 2019

The Maurice A. Deane School of Law at Hofstra University will host a free one-day legal assistance clinic for all veterans. It will be held on Sunday, March 31, from 9 a.m.-1  p.m. at the Law School, 2nd-Floor Atrium, 121 Hofstra University, South Campus, Hempstead, NY.

Veterans will receive a free one-hour consultation by appointment only with attorneys who have expertise in such areas as VA benefits and claims, family law, elder law, tax, wills, estates, disability, landlord-tenant disputes, and Medicare and Medicaid.

The clinic is organized by the Hofstra Veterans Legal Assistance Project (VLAP). For more information or to schedule an appointment, contact VLAP. Call 516-463-7302 or email VLAP@hofstra.edu.

To date, VLAP has provided more than 350 military veterans with free legal services.

The article “Tried and True: Fair Use Tales for the Telling” by Courtney Selby, associate dean for information services, director of the law library and professor of law, and Sarah E. McCleskey, head of resource and collection services at Hofstra University, was published in the Journal of Copyright in Education and Librarianship (Vol. 3, No. 1, 2019).

Abstract
On Thursday, March 1, 2018, the Harvard Library Office for Scholarly Communication hosted “Tried and True: Fair Use Tales for the Telling,” a one-day program celebrating Harvard’s Fifth Anniversary of Fair Use Week. Leading fair use scholars and practitioners shared their stories and engaged in lively discussion about the powerful and flexible fair use provision of the Copyright Act and its applications. Topics included treatment of the fair use doctrine in recent jurisprudence, conflicts over the use of visual works in remixes and mash-ups, academic work and social commentary, filmmaking, controlled digital lending practices in libraries, software preservation, and more. This article discusses the examples and ideas presented during the program and offers resources for further study in the application of fair use.

Last year a federal judge dismissed a similar suit filed by Russian information-security company Kaspersky Lab after it was banned from government contracts. Ku says Huawei will argue that this case is different because the US government isn’t just banning government agencies from doing business with Huawei, but also blocking agencies from doing business with users of the company’s gear.

“It’s a novel enough issue that it will go to appeal,” Ku says. “There will be quite a bit of litigation.”

If Mr Trump does decide to act, he has two main options. One would be to ask the attorney-general to intervene in the case to drop the charges altogether — something lawyers say would badly undermine the independence of the judiciary.

Hofstra Law BLSA Team Reaches Finals in 2019 Nelson Mandela Int’l Negotiations Competition

The Hofstra Law Black Law Student Association (BLSA) team of Olivier Labossiere 3L (at left in photo) and Jordon Flanigan 1L finished second in the 2019 Nelson Mandela International Negotiations Competition, a national competition offered by the National Black Law Student Association (NBLSA). Fifteen teams participated in the competition, which took place during the NBLSA’s national convention in Little Rock, Arkansas, from March 12-17.

The Nelson Mandela International Negotiations Competition is the only non-litigation-based competition offered by the NBLSA. The competition provides members with a unique opportunity to develop useful negotiation skills, while creating awareness of important global issues.

Hofstra Law Trial Advocacy Team Reaches Semifinals in 2019 Capitol City Challenge

The Hofstra Law team of Michael La Pinta 1L, Gabriella Klein 2L, Matthew Perticone 1L and Dana Suekoff 2L advanced to the semifinals in the 11th annual Capitol City Challenge, held from March 21-24 at the Tenley Campus of American University Washington College of Law.

The competition consisted of 24 teams. The Hofstra Law team went 4-1, besting teams from Chicago-Kent College of Law, Fordham University School of Law, UC Davis School of Law and the Norman Adrian Wiggins School of Law at Campbell University. The team lost in the semifinals to the team from Georgetown University Law Center, which ultimately won the competition.

The Hofstra Law team was coached by Carissa Danesi ’16, Laura Dorfman ’12 and Kaitlyn Flynn ’14.

The Capital City Challenge is hosted by American University Washington College of Law Stephen S. Weinstein Trial Advocacy Program and Mock Trial Honor Society. The competitors are evaluated and critiqued by approximately 50 experienced federal and state prosecutors, public defenders and private practice attorneys. The competition exposes participants to the dynamics of trial advocacy in a 21st-century courtroom.
